Scott Livingston’s years of experience have provided him with an ability to actively represent his clients in all types of business claims, including breach of commercial contracts, mortgage and lien enforcement, employment litigation, and commercial landlord/tenant matters. Mr. Livingston combines his ability to analyze complicated issues of law and fact with his ability to prepare a simple but effective argument to create a powerful litigation strategy for his clients' matters.
Whether representing clients in state, federal, or appellate courts, Mr. Livingston has a record of success in court. Previously, Mr. Livingston has appeared in numerous courts around the State of Florida defending the firm's banking clients, including putting an end to the frivolous filing of claims under the Magnuson-Moss Warranty Act. Mr. Livingston continues to represent those banking clients in the most complex of mortgage and lien enforcement cases.
Although Mr. Livingston is very adept at conducting focused discovery and preparing a matter for trial, he is also able to quickly recognize when his clients are best served through alternative dispute resolution, such as mediation, arbitration, or structured settlement. When early resolution is possible and appropriate, he counsels clients through those issues as effectively as he represents clients in court. Mr. Livingston’s reputation among fellow attorneys, mediators, and the judiciary is that he is always prepared, will fight for clients' rights, and will make sure that his adversary complies with the applicable rules of procedure and law.
